Hey, my husband and I are about to adopt an embryo here in the U.S. and we are kinda confused with the concept, as the term ‘adoption’ is constantly being used but we think it’s not the same actually. So what’s the difference? Or do they have something in common such as the legal framework or something?

The truth is, in the USA the placement of embryos into an adopting family is governed by property law. Current legislation only applies to the placement of a child after they are born. Thus, we can conclude that adoption laws cannot be applicable in the case of embryo adoption.
However, most embryo adoption agencies apply the best practices of the traditional adoption process, as the final result is indeed the birth of a child, and the resulting relationship of the adopting parents with the child is just as binding as if it were a legal adoption.
In some states such as Georgia, Missouri, and Kansas, adoptive parents finalize the process of embryo adoption in the courts, although this is not always required.
